1. Service Provider
The “Pisa Tour Admin” service is provided by Francesco Nicolas Fabio Vibert, sole proprietor of the business Francesco Nicolas Fabio Vibert, with registered office at Piazza Giuseppe Garibaldi 3, Vicopisano, VAT number 02501890509, email support@vibertsoft.com.
2. Subject of the Contract
Pisa Tour Admin is a digital platform reserved for business operators, aimed at managing content and information published on the “Pisa Tour” app.
The service is intended exclusively for individuals acting in the course of their business or professional activity (B2B relationship). Use by consumers, as defined under Legislative Decree 206/2005, is excluded.
3. Registration and User Declarations
The user declares and warrants that:
- they are acting as a professional or business entity;
- the information provided is true, up to date, and complete;
- they are the holder or authorized user of the VAT number provided.
The Provider reserves the right to suspend or revoke the account in the event of false information or improper use.
4. Conclusion of the Contract
The contract is deemed concluded upon activation of the subscription following payment of the first fee.
5. Subscription and Payments
Access to the services is subject to the subscription of a monthly plan with automatic renewal.
Payment is made in advance via Stripe. On each renewal date, a proper electronic invoice is issued through the Exchange System (SDI).
Payment data is processed exclusively by Stripe as an independent data controller.
6. Automatic Renewal
The subscription renews automatically each month unless canceled before the renewal date.
Cancellation may be made at any time without providing reasons. Cancellation prevents subsequent renewal but does not entitle the user to a refund for the already paid period, which remains active until its natural expiration.
7. Withdrawal and Refunds
The service is classified as a digital service provided to professionals.
No right of withdrawal with refund is provided for periods already invoiced or already started.
No refunds, whether full or partial, are provided for failure to use the service.
8. User Obligations
The user is solely responsible for:
- the content published;
- the accuracy of the business information entered;
- compliance of the content with applicable laws.
It is prohibited to publish unlawful, defamatory, misleading, or otherwise illegal content.
9. Limitation of Liability
The service is provided “as is”.
The Provider does not guarantee:
- uninterrupted availability of the service;
- absence of technical errors;
- specific economic or commercial results.
Except in cases of willful misconduct or gross negligence, the Provider’s total liability for any reason arising from this agreement shall in no event exceed the total amount paid by the user in the three months preceding the event giving rise to the damage.
The Provider shall not be liable for:
- indirect damages or loss of profit;
- malfunctions of third-party services (Stripe, Firebase, hosting);
- force majeure events.
10. Intellectual Property
Software, trademarks, logos, and content are the exclusive property of the Provider. Any unauthorized reproduction or use is prohibited.
11. Suspension or Termination of the Service
The Provider may suspend or terminate the service for maintenance, contractual violations, or legal obligations.
12. Contractual Amendments
The Provider may modify these terms. Changes will be communicated via the app or email.
13. Legge applicabile e foro competente
This agreement is governed by Italian law.
The Court of Pisa shall have exclusive jurisdiction over any disputes.
14. Specific Approval of Unfair Terms
Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the user declares that they have read and specifically approve the following clauses:
- Art. 5 (Subscription and Payments);
- Art. 6 (Automatic Renewal);
- Art. 7 (Withdrawal and Refunds);
- Art. 9 (Limitation of Liability);
- Art. 11 (Suspension or Termination of the Service);
- Art. 13 (Applicable Law and Jurisdiction).
